The second most common type of insurance disputes (besides injury claims) involve homeowners' insurance. This type of insurance insures you and your property for your negligence as well as damage to the property by flood, fire, mold, wind, storm, sinkholes, etc. A very grave lesson learned in the 2004 and 2005 hurricanes were that some insurance policies insured only for "storm" or "wind" but not "flooding." The same homes often had another policy for "flood" damage which does not cover wind or storm damage. The situation this put thousands of people in was that neither insurance coverage would cover the losses. Each insurance company would deny the claim and insist that the other type of loss caused the damage to the property. The insurance companies were EAGER to deny coverage in those cases and without aggressive attorneys, it would have gone unchecked.
